This is general information, not legal advice. Check your lease and local (city) rules, which can be stricter.
Fastest and slowest deadlines
14 days is the shortest deadline in the table: Alaska, Arizona, Hawaii, Nebraska, New York, Vermont. 60 days is the longest: Alabama, Arkansas, West Virginia.
Kentucky and Tennessee have no fixed deadline in the statute, so the deadline there turns on the lease and the general obligation to account for the deposit.
How to protect your deposit when you move out
Most deposit disputes are about cleanliness, not damage. Three things reduce the risk:
- Clean to the checklist the landlord uses. The move-out cleaning checklist covers the rooms and surfaces that get flagged most: oven, fridge, inside cabinets, bathrooms, floors and window tracks.
- Document the condition before and after. Photograph and video every room on the day you move in and the day you move out, with a date visible. Keep them for at least a year after you leave.
- Know what a fair clean costs before you pay someone. Use the move-out cleaning cost calculator so you can tell a normal price from an inflated one, and keep the cleaner's invoice.
Can a landlord charge cleaning out of the deposit?
In most states, yes - but only to return the unit to the condition it was in when you moved in, apart from normal wear and tear. The difference that matters in practice is scope: a charge for a clean that restores the original condition is usually allowed, while a charge for routine wear, repainting between tenants, or "make-ready" work the landlord would do anyway is usually not. The table above says what each state's statute actually provides, and where the statute is silent it says so instead of guessing.
If your deposit is not returned
Keep it factual and in writing. Send the landlord a dated letter or email listing the deposit amount, the date you moved out and vacated, the date the deadline fell, and what you are asking for. Attach your move-out photos and the cleaning invoice. Many states allow extra damages or a penalty when a deposit is withheld past the deadline, and several require the landlord to pay them if a court finds the withholding was not justified - the state row above links the statute that applies to you.
Small claims court is the usual route for a deposit dispute. It is designed for people without a lawyer, and the filing fees are modest. Check your state court's self-help pages for the process and the limit in your state.

Method
Each row was checked against the state's own published law, or where the statute is hard to read, against an official attorney general or housing agency guide. Where no official source could be confirmed, the row says "See state law" rather than repeating a number from a commercial summary site. Deadlines sometimes run from the day the tenancy ends and sometimes from the day the tenant returns possession or provides a forwarding address, which is why the qualifier is shown next to the number. City ordinances can add stricter rules, so check those too.
Frequently asked questions
How long does a landlord have to return a security deposit?
Between 14 and 60 days depending on the state, counting from move-out or from the end of the tenancy. The table above gives the number and the exact start point for each state, with a link to the statute.
Can a landlord keep the deposit for cleaning?
In most states cleaning is deductible if it restores the unit to the condition it was in at move-in, excluding normal wear and tear. Some states name cleaning explicitly in the statute and others only allow damages. The state rows above distinguish the two.
Does the landlord have to send an itemized list of deductions?
Most states require it, and several require receipts or invoices for the items listed. The table marks which states require an itemized statement.
Is there a maximum security deposit?
About half the states cap it, usually at one or two months' rent, and a few cap it by reference to whether the tenant has pets or the landlord owns few units. Others set no statutory maximum.
What if the landlord misses the deadline?
Many states add a penalty or allow the tenant to recover extra damages, sometimes a multiple of the deposit. The statute linked in your state's row states the consequence.
Do these rules apply to my city too?
City ordinances can be stricter than state law, especially in large cities with rent stabilization. Check your city's tenant handbook as well as the state rule.
